Dear Schodack CSD Community,
At this point, you have likely heard the news about the Nassau County Supreme Court’s ruling regarding mask mandates that was announced late last night.
Since that time the New York State Department of Health (NYSDOH) has appealed the Nassau County Supreme Court’s ruling. We have been advised that this appeal will result in an automatic stay on the ruling, which would keep the mask mandate in place until an appellate court issues a further ruling.
Additionally, prior to the NYSDOH appeal, the following statement from the New York State Education Department was also issued to schools this morning in response to the ruling:
It is SED’s understanding that the Department of Health will appeal the Nassau County Supreme Court decision, which will result in an automatic stay that will unambiguously restore the mask rule until such time as an appellate court issues a further ruling. Therefore, schools must continue to follow the mask rule.
This morning we were also in contact with our school district’s attorney and they have advised us that Nassau County’s ruling does not claim it is intended to be enforced state-wide, only within their county.
With all of these factors taken into consideration, at this time we are still required to have students and staff wear masks in Schodack schools.
